Welcome to Beds4U. These Terms of Service apply to your access to and use of our website, products, services, and in-store purchases. By interacting with our platforms, you agree to comply with these Terms.

If you do not agree with these Terms, please do not use our services.

1. General

Beds4U reserves the right to amend, update or change these Terms of Service at any time without prior notice. Changes will take effect immediately upon being published on our website.

By continuing to use our website, you accept any updated Terms.

We reserve the right to limit quantities, cancel orders, or refuse service where reasonably necessary for security, fraud prevention, or operational reasons.

2. Products, Pricing & Availability

All products displayed on our website are subject to availability.

Beds4U reserves the right to:

• Correct errors in pricing or descriptions
• Withdraw or discontinue any products
• Limit quantities purchased by customers
• Substitute items when reasonably necessary
• Change pricing and specifications without notice

Product finishes and colours may vary slightly from online images due to screen settings and manufacturing variations.

We make every effort to ensure accuracy; however, Beds4U does not guarantee that website content is completely error-free at all times.

Customers are responsible for ensuring products are suitable for their specific environment and comfort preferences.

3. Orders & Acceptance

Once an order is placed, you will receive a confirmation. This does not guarantee acceptance of the order.

Beds4U reserves the right to decline or cancel orders at any time before delivery, particularly where:

• Stock is currently unavailable
• Pricing or content errors exist
• Fraudulent or suspicious activity is suspected
• Payment verification cannot be completed
• Delivery limitations are identified
• Terms or conditions are breached

If an order is cancelled after payment, a refund will be issued.

4. Pricing & Payment

All prices are in New Zealand Dollars (NZD) and include GST unless stated otherwise.

Full payment must be completed before products are dispatched unless finance arrangements are approved.

Beds4U is not responsible for finance application outcomes or third-party payment processing delays.

We reserve the right to cancel orders where payment is reversed or suspected to be fraudulent.

5. Ownership & Risk

Title to the products remains with Beds4U until full and cleared payment has been received.

Risk in the products passes to the customer upon delivery or collection.

Authority to leave a delivery at unattended premises is entirely at the customer’s risk.

If delivery is unable to be completed due to customer-related circumstances, Beds4U may:

• Charge storage or re-delivery fees
• Return the items to storage
• Cancel the order subject to fees

Customers are responsible for ensuring suitable delivery access prior to purchase.

6. Delivery & Collection

Delivery times provided are estimates only and may vary depending on stock availability and freight schedules.

Beds4U is not liable for delays outside of our reasonable control.

Customers must ensure:

• Delivery information is accurate
• Access is safe and suitable
• Products fit through intended spaces
• Someone is available to accept delivery

Additional charges may apply for rural deliveries, difficult access, or failed delivery attempts.

Valid identification may be required for Click & Collect orders.

Orders not collected within a reasonable timeframe may be subject to storage fees or cancellation.

7. Returns, Faults & Consumer Guarantees

Customers are required to inspect all products at the time of delivery or collection.

Any damage or incorrect items must be reported within 5 days of receipt, accompanied by clear photographic evidence.

Failure to notify us promptly may affect our ability to assess the source of the damage.

We reserve the right to inspect products and documentation before approving any claim or repair.

In accordance with the Consumer Guarantees Act 1993, Beds4U may repair or replace products before issuing a refund.

Beds4U is not responsible for:

• Post-delivery damage or misuse
• Failure to follow care guidelines
• Normal wear and tear
• Comfort preference issues
• Use with unsuitable foundations

Sleep products must be maintained in a sanitary condition. We reserve the right to decline claims for soiled or unsanitary items.

Customers are encouraged to use a mattress protector at all times.

Personal comfort preferences do not constitute a product fault under New Zealand law.

For hygiene reasons, bedding products cannot be returned once used unless faulty.

Nothing in these Terms limits your statutory rights under the Consumer Guarantees Act 1993.

8. Refunds & Cancellations

Beds4U does not provide refunds for change of mind purchases. Choose carefully before ordering.

Where a product is faulty, we will provide an appropriate remedy such as repair, replacement, or refund.

Other refunds are provided at the discretion of Beds4U.

If an order is cancelled, a restocking and administration fee of up to 10% may apply to cover costs incurred.

Custom orders, clearance items, or floor stock may not be eligible for cancellation or return once processing has begun.

9. Promotions, Discounts & Offers

Promotional offers are subject to specific terms and conditions and may be changed at any time.

Unless otherwise stated:

• Promotions cannot be combined
• Offers are subject to availability
• Promotional pricing can change without notice

Beds4U reserves the right to:

• Correct promotional errors
• Cancel offers or refuse claims
• Reverse discounts applied in error
• Cancel orders resulting from technical errors

10. Finance

Finance offers are subject to approval by the provider’s lending criteria, fees, and terms.

Beds4U is not responsible for finance application decisions or third-party provider actions.

We may delay or cancel orders if finance applications are declined or reversed.

11. Website Use

You agree not to misuse the Beds4U website or interfere with its security and operation.

You must not:

• Use the site for unlawful purposes
• Upload malicious code or content
• Attempt unauthorised access to data
• Reproduce website content without permission

Beds4U may restrict access to services where misuse or security concerns arise.

12. Intellectual Property

All website content, including logos, graphics, and descriptions, are the property of Beds4U and may not be copied without written permission.

13. Limitation of Liability

To the fullest extent permitted by law, Beds4U is not liable for indirect or consequential losses, including loss of profit or business interruption.

Our liability for claims is limited to repair, replacement, or refund of the purchase price.

Nothing in these Terms limits rights available under New Zealand consumer law.

14. Force Majeure

Beds4U is not liable for delays or failure to perform obligations caused by events outside our control, such as natural disasters, shipping disruptions, or pandemics.

16. Governing Law

These Terms of Service are governed by the laws of New Zealand.

Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
